These terms govern access to the BENSS website and the enquiry-led process for viewing and acquiring contemporary artworks.

Website Use

This website provides information about BENSS, the artist, artworks. You may browse it for lawful personal or professional purposes. You must not interfere with its operation, attempt unauthorised access, misuse forms, scrape protected content at scale, or represent website material as your own.

Artwork Information

Artwork images, colours, dimensions, dates, media, condition notes, framing details, availability, and other descriptions are presented with reasonable care but may be updated. Screen colour, scale, and texture are not exact substitutes for viewing a work or reviewing current documentation.

Availability and Pricing

Availability and displayed prices are invitations to enquire for buying. A work may be reserved, withdrawn, or placed in a private collection without notice. Taxes, framing, crating, insurance, transport, customs, and import charges may be quoted separately.

Quotes

A written quote identifies the work, price, currency, validity period, included services, excluded costs, payment schedule, and any conditions. Unless the quote states otherwise, it does not reserve a work. Reservations are confirmed only in writing by BENSS.

Orders and Payment

An acquisition becomes binding only when the buyer accepts the applicable written terms and the seller confirms the order. Payment methods, deposits, balance dates, invoicing details, and title transfer should be stated in the final agreement. Never send payment to changed bank details without independent verification.

Framing and Custom Requests

Framing, glazing, mounting, installation, or other custom requests may affect price, dimensions, timing, handling, and cancellation rights. Natural variation and hand-finished details are not necessarily defects. Any approved specification should be recorded in writing before work begins.

Lead Times

Any preparation, framing, conservation, crating, or delivery estimate is given in good faith and may change because of materials, specialist availability, carrier schedules, customs, or circumstances beyond reasonable control. A revised estimate should be communicated as soon as practical.

Delivery and Installation

Delivery terms should identify destination, carrier, insurance, access requirements, responsibility for duties, inspection on arrival, and any installation service. The buyer must provide accurate access and contact information and report visible transit damage according to the carrier’s procedure.

Returns and Cancellations

Cancellation and return rights vary by country and by whether a transaction is remote, business-to-business, personalised, or made to order. The final sales agreement states the applicable cancellation, return, damage, and refund terms without limiting mandatory consumer rights.

Intellectual Property

Unless stated otherwise, the website design, brand elements, editorial text, artwork images, and other content are protected by intellectual-property rights. Browsing does not transfer ownership or grant permission to reproduce, publish, adapt, train models on, commercialise, or distribute protected material.

Liability

Nothing in these terms excludes liability that cannot lawfully be excluded. Subject to applicable law and the final agreement, BENSS is not responsible for indirect or unforeseeable loss arising solely from use of this informational website. Clients remain responsible for professional, tax, customs, installation, and conservation advice appropriate to their circumstances.

Governing Law and Contact

These terms are governed by the laws of Canada, Quebec, subject to any mandatory protections that apply in the client’s country of residence. Disputes that cannot be resolved amicably are submitted to the competent courts of Quebec where legally permitted. Questions may be sent to stacy@benss.com.
